1. Acceptance of Terms

By accessing or using Vistly ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Account Registration

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• You are responsible for all activity that occurs under your account.

3. User Content

Ownership

You retain ownership of all content you post to Vistly, including images, prompts, and comments. By posting content, you grant Vistly a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content on the Platform.

Content Guidelines

You agree not to post content that:

• Infringes on the intellectual property rights of others.
• Contains illegal, harmful, threatening, or harassing material.
• Contains explicit sexual or violent content without appropriate warnings.
• Misrepresents its origin or creation method.
• Contains malware, spam, or deceptive content.

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts of repeat offenders.

4. Prompts and Remixing

By sharing prompts on Vistly, you acknowledge that other users may view, copy, and remix your prompts to create new works. This is a core feature of the Platform, and all users participate with this understanding.

When you remix another user's prompt, the original creator is credited through our remix chain feature. You must not remove or obscure remix attribution.

5. Prohibited Activities

You agree not to:

• Use the Platform to violate any applicable law or regulation.
• Scrape, harvest, or collect user data without consent.
• Attempt to gain unauthorised access to the Platform or its systems.
• Interfere with or disrupt the Platform's operation.
• Create multiple accounts to manipulate votes or engagement.
• Use automated tools to interact with the Platform without our written permission.

6. Intellectual Property

The Vistly name, logo, design, and platform code are owned by Vistly and protected by intellectual property laws. You may not use our branding without written permission.

7. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Platform ceases immediately, but these Terms shall survive as applicable.

8. Disclaimers

The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted, secure, or error-free operation. We are not responsible for the accuracy, quality, or legality of user-generated content.

9. Limitation of Liability

To the maximum extent permitted by law, Vistly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
